In case you were planning on buying the Galaxy Nexus, especially from Verizon Wireless, we have some good news for you. Samsung was successful in its bid to bypass the sales ban on the Galaxy Nexus. Securing its position, the Galaxy Nexus will remain on shelves, at least till Aug. 20.
On Monday, Samsung recorded a minor victory in the ongoing Apple versus Samsung patent battle by escaping the sales ban for the Galaxy Nexus for the second time. On Monday, U.S. Court of Appeals for the Federal Circuit ordered temporary stay on the ban, extending the suspension to Aug. 20.
The ban stems from a lawsuit filed against Samsung in February this year. Apple accused Samsung of infringing several of its patents with the Galaxy Nexus smartphone.
Recalling the action, California District Court judge Lucy Koh granted Apple a patent-related injunction against the Samsung device in June. Apple posted a $96 billion bond required for the ban. As a result, the device disappeared from shelves as well as the Google Play Store.
Android 4.1 Jelly Bean update helped Galaxy Nexus in bypassing the ban and Google resumed selling the unlocked version of Galaxy Nexus on the Play Store. Samsung also went past California district court to the Federal Circuit to appeal for a suspension on the ban. U.S. Court of Appeals for the Federal Circuit granted an immediate stay on Samsung Galaxy Nexus ban in early July. As of the latest hearing, Samsung can continue to sell the smartphone until at least Aug. 20.
According to Florian Muller, a blogger at Foss Patents, Samsung has time until Aug. 6 to file a brief reply, while the hearing is scheduled for Aug. 20.
"Since the appeal can be adjudicated anytime after the August 20 hearing, it would make sense to just stay the injunction for the remainder of the appeals process given that a disruption of its sales is clearly more harmful to Samsung than an extended stay is to Apple," Muller wrote on Foss Patents.
Galaxy Nexus is in a safe zone, at least for a while. However, Samsung doesn't have time to rejoice. Apple versus Samsung trial kicked off this week with both parties making their opening statements on Tuesday for the case.
